This was no secret. So why did the California Agricultural Labor Relations Board take five years to count the ballots, after threatening to destroy them?

The historic abuse of power the Agricultural Labor Relations Board has exerted over family-owned Gerawan Farming and its thousands of workers is illegal. Gerawan’s farm workers do not want union control of their workplace or work lives, but have been targeted by the United Farm Workers labor union and the ALRB since 2012 for takeover.
In May, the Court of Appeals ordered the stateAgricultural Labor Relations Board to count the workers’ decertification votes from a 2013 election, but the agency has ignored the order, and still wants to destroythe ballots and instead force a non-negotiated “contract” on the workers.
The workers have appealed to the legislative Latino Caucus, individual legislators, Governor Jerry Brown, and the California Supreme Court. Despite awaiting legal remedies, the Legislature is again doing the bidding of the United Farm Workers in an end run.

Gerawan Farming workers just won a huge victory over the United farm Workers labor union and California Agricultural Labor Relations Board. In a 3-0 decision, the Fifth District Court of Appeal ordered the California Agricultural Labor Relations Board to count the workers’ ballots from the November 2013 election to decertify the United Farm Workers labor union, and issue a tally.
Surprising no one, on Nov. 27, the California Supreme Court upheld the dubious Mandatory Mediation and Conciliation law against Gerawan Farming. The California Supreme Court heard the Gerawan case last fall on whether the state’s attempting to force mandatory agricultural labor union contracts violates the constitutional safeguard of equal protection. Fresno-based peach grower Gerawan Farming is one of the largest agriculture employers in the state.

California Gov. Jerry Brown and the Democrat-supermajority State Legislature hold the state Supreme Court’s purse strings. Evidence of this can be found in the MondayCalifornia Supreme Court 7-0 decisionin the Gerawan Farming case.
Gerawan Farming just filed a motion with the ALRB to disqualify former Sen. Isadore Hall from making any decisions related to their pending cases. And for good reason. Not only does Sen. Hall have no experience in or relatedto agriculture,Hall even voted for the “farmworker overtime bill”to force morefarming employersinto United Farm Workers union contracts.
California’s promise of opportunity for everyone has been all but eradicated by gross political mismanagement, political corruption, and watered down representation. It’s time to drain the swamp in California politics.
