Yesterday was a pretty good day. The Fourth Circuit Court of Appeals upheld a charter amendment I wrotefor the City of Newport Beach in a unanimous decision. The charter amendment locates the future City Hall building on city-owned property adjacent to the Newport Beach Central Library at Fashion Island.

Initiative proponents William Ficker, Jack Croul and Marian Bergeson were responsible for qualifying the initiative for the ballot in February, 2008, but were opposed in the campaign by a majority of the City Council, who had other ideas about where the City Hall should be.STA Campaignsmanaged the effort for the proponents. After a spirited campaign, the voters decided by a 53% to 47% vote to pass the initiative. Opponent Allan Beek, an "open space" advocate,waged the campaign against the measure, and filed pre-election and post-election Superior Court challenges, losing on all counts. He then took his appeal, and now the decision of the three-judge panel at the Court of Appeals willmost likelyclose this chapter in Newport Beach history.

Today legislative Democrats will apparently bring forward their budget amendment plans in a series of votes today. Republican legislators should prepare to vote no – no, no, no, no…

Here are a few key reasons why this plan, being put forward by Democrats, should be rejected in its entirety.

No Transparency Or Notice: No one is really sure what is actually being voted on today. In principle, GOPers (and frankly, Democrats, too) should reject any legislative proposals being put up for a vote that have not been in print for 72 hours and all of the legislators have had time to read the actual language, and get input from whatever sources they deem helpful. California Businesses Continue To Shed Jobs – 68,000 More Jobs Lost In May

“The state lost 68,900 jobs in May as unemployment rose from a revised 11.1% in April and 6.8% in May 2008. This is the highest rate since the national record-keeping system began in 1976. The news that Juan Arambula switched his Party designation from Democrat to DTS is not a big deal. Juan is now and always has been one of the most left leaning Assemblyman in the State. He is a sensible, rationale person, however, and not an angrynut job like most of his former caucus members. Even he sees that taxes in this economy are off the table. That isn’t a moderate position –its an obvious position. Juan may be wrong about a lot of issues – but he is at least thoughtful, and a gentlemen, and able to see the obvious.
