Steve Cooley On Prop. 8 Decision

GOP Attorney General nominee on the Prop. 8 ruling:

"Barring a law that is unconstitutional on its face, the proper role of an Attorney General is to enforce and defend the will of the People as manifested through the initiative or legislative process. The will of the People should be respected and not overturned easily or lightly. Today’s decision by a federal judge overturning Proposition 8 should be appealed and tested at a higher level of our legal system. The California Supreme Court upheld Proposition 8 by a 6 to 1 vote and declared it to be constitutional. Likewise, if the voters had approved an initiative legalizing same-sex marriage and a federal judge had ruled against it, I would also support an appeal of that decision."

The Supreme Court of Mexico has upheld Mexico Cities law allowing gay marriage by a vote of 8 yes to 2 no. The United States is now surrounded by nations that allow gay marriage. What will our appeals court do?

  2. dstout4@hotmail.com Says:

Surely, Mr. Evans, you can understand the difference between a court UPHOLDING a duly enacted law, as the Mexican court did, and a court STRIKING DOWN a duly enacted law, passed directly by 52% of the voters, as Judge Williams did. Judicial deference in the former case vs. judicial arrogance in the latter.

Again Flash Report Junkies twitter and coo over dumb social issues….while you decide if marrying your pet rock is constitutional or holding hands with your third cousin Rachel from Appalachia is cool…. Whitman and Brown are flipping and flopping like a chunky channel cat in the bottom of the California fiscal boat to hell.

After I stopped laughing at the above Bosich post I realized that, despite the “flipping and flopping like a chunky channel cat” humor, calling Prop. 8 a “dumb social issue” was not funny at all.

Outside the political arena Prop 8 is a very serious issue….we may see people marrying their lamb, cow, horse, cousins, nieces, grand kids and ask for dependant tax deductions….we could see multi-partner marriages….the sky is the limit once the “barn door” is let open….

Morality, religion, dignity, gender roles are all at risk….ala Obama’s “collective salvation” wherein the STATE will judge us into a utopian eternity.
